今回の”responsible”は一般的な英文でもよく出てくる単語です。”liable”はそこまで見慣れていないかもしれません。どちらも「責任がある」という意味になりますが、元々の意味合いはちょっと違うようです。”liable”には不法行為責任や契約履行責任を負う場合、つまり不法行為や不履行が生じたときには賠償責任を負う、という意味があり法律上の概念と言えます。一方、responsible”は、義務の遂行能力など”liability”の根拠となる事由が存在している、という意味になります。一般的に「責任を持つ・責任がある」というときに使われる用語です。ただし、現在では使われるうえで両者の差はほとんどない、と言われています。では例文を見てみましょう。
【例文】
① ABC is responsible for the maintenance of the building.
② Responsible officers shall decide the business of the Company in accordance with the provisions of its regulations.
③ In the event of assignment of this Agreement or any right hereunder or delegation of the obligations hereunder, the assigning or delegating party shall remain liable to the other party and shall not be relieved of any obligation hereunder.
④ In no event shall ABC be responsible or liable for any damage to the Products occurring in transit. Any claim for such damage shall be directly made by XYZ against the carrier or an insurance company.
【訳文例】
①ABCは、建物の管理責任を負う。
②担当役員は、規則で定めるところにより、全社業務を決定する。
③本契約もしくは本契約上の権利の譲渡または義務の履行委任がなされた場合、譲渡または履行委任を行った当事者は、他方当事者に対して引き続き責任を負い、本契約上の義務を免れない。
④いかなる場合もABCは、運送中に生じた本製品の毀損について責任を負わない。当該毀損に対するクレームは、XYZが運送会社または保険会社に対して直接なす。

④のように、”responsible” or “liable”というような使われ方もあります。このように、実務上両者の差がほとんどない場合もあります。
